ST. CLOUD, Fla. -

The family of a former firefighter who sued the city of Orlando after he contracted Hepatitis C has found out he was buried in the wrong spot.

Bob Flamily died in May 2007. In 2001, he was the first Orlando firefighter to sue the city claiming medical personnel knew he had contracted Hepatitis C on the job, but he was never told about it.

His final resting place is Mount Peace, a cemetery owned and operated by the city of St. Cloud. But recently his family got a call saying the cemetery made a mistake.

His vault was not under his headstone. It was the next row over.

The staff at the cemetery says the mistake did not happen on their watch --it happened under old management.

The staff said they were doing work in the area and when using a probe, they discovered there was no vault where Flamily was supposed to be. There was a vault where nobody was supposed to be.

The plan is to officially identify the vault and move it to where it belongs.
