Adam Gutowski

HONOLULU -

The friend of the federal agent on trial for a 2011 Waikiki killing says he didn't see what was happening to the agent because he was getting beat up.

Adam Gutowski says he was getting "severely beaten" by Kollin Elderts, who was later shot and killed during the altercation at a McDonald's restaurant.

Gutowski is continuing to testify Tuesday in the trial against State Department Special Agent Christopher Deedy, his former college roommate and fraternity brother.

He had been living in Waikiki for about a year and Deedy was in town for work.

Gutowski says the surveillance video seems to support what he believes -- that Elderts and his friend, Shane Medeiros, were beating on him on the night of the shooting.

Gutowski says the video shows Elderts punching Deedy more than once, but the prosecution pressed him on how he could have seen that happen since he was on the ground.

Gutowski also says he doesn't remember anyone saying "haole" during the altercation. The defense claims Elderts was bullying a customer with racial slurs.

Under cross-examination by the defense, Gutowski continues to maintain that Deedy wasn't drunk that night.
