Closing arguments Tuesday in Toby Stangel case

On Monday, a judge reminded Toby Stangel he had the right to testify, but jurors could not hold his silence against him.

The only word uttered from Stangel in court on Monday was "no," when he chose not to testify on his behalf. 

On Monday,  firearms and gun residue experts took up most of the day in court. 

Closing arguments are set for Tuesday morning. 

Stangel is charged with eight counts of murder, attempted murder and numerous other drug and firearms charges. 

Prosecutors said he killed a woman, injured two motorists and shot at two police officers during the early morning June 2011 shooting spree.
Jurors have heard testimony from witnesses including a daughter of the woman who died and the man and woman who were shot while driving on the H-1 freeway.

Stangel's attorney claimed his client was "temporarily insane " at the time of the shootings, saying Stangel was high on alcohol and drugs. 

But a judge denied that request. 

Stangel faces life in prison without parole.
