A judge has chosen the verdict for a man convicted of killing a police officer after he was accused of falling asleep at the wheel of his truck.
Honolulu Police officer Eric Fontes was killed in 2011 after the truck driven by James Dorsey slammed into him near Honokai Hale.
A jury found Dorsey guilty of misdemeanor negligent homicide, but also found him guilty of felony injury for another officer that was hurt in the crash.
The judge found that ruling was inconsistent. Following a hearing on Wednesday, Judge Glenn Kim decided to keep the charge of misdemeanor negligent homicide.
Dorsey faces up to one year in prison when he is sentenced in January.
