Judge denies Deedy's request for case dismissal
The federal agent involved in a high profile McDonalds shooting will not see his case dismissed, despite a request to the court.
Christopher Deedy is accused of killing Kollin Elderts inside a Waikiki McDonalds.
Deedy called upon a Supremacy Clause which allows federal law to trump state law. The agent insists he was acting within his duty as a federal agent on the night of the shooting and should not be charged.
Monday afternoon Judge Karen Ahn rejected his claim.
Jury selection is underway in his re-trial which is expected to begin in July.
