Prosecutor in Deedy trial blasted by victim's parents

HONOLULU -

The parents of a man shot and killed by a federal agent in a Hawaii McDonald's restaurant want a new prosecutor to handle the upcoming retrial.

Kollin Elderts' parents on Friday blasted Honolulu Prosecuting Attorney Keith Kaneshiro and Deputy Prosecuting Attorney Janice Futa, who tried the case against State Department Special Agent Christopher Deedy.

Parents Jennell and Kendall Elderts say they were "abandoned" and lied to by prosecutors who didn't ask the judge to allow the jury to consider a lesser manslaughter charge.

Elderts' parents say there needs to be a new, more aggressive prosecutor.

City Prosecutor Keith Kaneshiro responded by saying, "The statements made by the Elderts family are not true.  No promises were ever made regarding charges.  We prosecute cases according to the evidence and the law and are not influenced by civil cases."

A jury in August was unable to reach a verdict against Deedy, charged with murder in the 2011 Waikiki shooting. A retrial is scheduled for June.
